She ruled further that, in the event of the security not being finalised on time, the agency may apply for the dismissal of the pair's lawsuit. Kathree-Setiloane also ordered the two to pay for the NYDA's costs for this application.
In March, the pair lodged a R36-million lawsuit against the National Youth Development Agency after it had reneged on a deal to fund an IT project named "The Howzit venture". The project centred on a touch-screen application involving large computer monitors placed at universities, colleges and shopping malls around the country and offering free internet access and advertising for poor students. The agency undertook in writing on December 14, 2009 to fund the project but later withdrew.
In May, the NYDA asked the two men to furnish them with security for costs after realising that the software company had never traded. The NYDA said it feared that it would not be able to recover its costs from the pair should it win the court action.
